Terms of Service

Welcome to Respeak. These Terms of Service ("Terms") govern your use of the Respeak Telegram bot and tryrespeak.com (collectively, the "Service"), operated by Respeak ("we," "us," or "our"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

Respeak is a voice translation service that operates as a Telegram bot. You send a voice message in one language and we deliver a translated voice message in another. We rely on third-party services (OpenAI, Telegram) to provide the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you confirm you meet this requirement.

3. Plans and pricing

Respeak offers three plans:

Pricing is shown in Telegram Stars at the time of purchase. We reserve the right to change pricing or plan terms with reasonable notice.

4. Payments and refunds

Payments are processed via Telegram Stars. By purchasing a subscription, you authorize the charge through Telegram. Subscriptions are billed for a fixed period (e.g., one month) and do not auto-renew unless explicitly stated.

Refund requests are handled on a case-by-case basis. Email us at info@tryrespeak.com within 7 days of purchase if you believe you're entitled to a refund. We may issue refunds at our discretion in cases of service unavailability or billing error.

We may suspend or terminate accounts that violate these rules, with or without notice.

6. Content ownership

You retain ownership of the voice messages you send. By using the Service, you grant us a limited license to process your messages solely for the purpose of providing the Service (transcription, translation, and synthesis). We do not claim ownership of your content and do not use it to train AI models.

7. Service availability

We aim to keep the Service available 24/7 but do not guarantee uninterrupted access. We may pause or modify the Service for maintenance, upgrades, or other reasons. We are not liable for downtime caused by third-party providers (Telegram, OpenAI, our hosting services).

8. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee:

You use the Service at your own risk. Do not rely on the Service for legal, medical, or other critical communications without independent verification.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ends, but Sections 6, 8, 9, 10, and 13 survive.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. We will notify you of material changes via the Service or email. Continued use after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the United States, and you consent to the exclusive jurisdiction of those courts.
